Hello,

I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.

Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?

Looking for suggestions ASAP , thanks

Hello,
My husband is on pending I-485 MTR & my denied I-140 is in appeal. My husband has to apply for H-4 status based on my approved & stamped H-1 status.

My Queries:

1) I am told that he cannot apply from USA as his I-485 is denied and he is pending I-485 MTR?

2) Can he apply for canadian visa for H4 consulate processing even though he doesn't have valid USA stamp on his passport? All we have is pending I-485 MTR receipt & my pending appeal letter from AAO office.

3) How safe is it to apply from canada?

Your response will be highly appreciated.

Dear Sir/Madam,

My h1b status (and I94) is valid till 20 Feb 2010. Few days back I have applied for my h1b extention on PP after completing 4 years 6 months. My I140 got rejected couple of months back and I appealed on it, It is on pending now. Basically i am looking for an options if my h1b extention gets denied , can i appeal for h1b extention and get h1b extention based my I140 appeal. Are there any other ways to continue to work in usa? or Do I need to leave usa immediatly? if yes with in how many days?

Greatly appreciated your help regarding this. Please kindly help me regarding this.

I have a offer from an employer and they say that they will be able to provide documentation for GC processing but will not be able to sponsor. What does that mean? Can i hire attorney for my GC processing(EB2) and pay the expenses by myself? What else would be required from the employer?

However, before making a decision to travel, you should consult with an immigration attorney fully familiar with your immigration and employment history.
