You will be able to return to same employer if you get employed again with your old employer.
Alternatively, you can file new H1 with a new employer. YOu dont need to go visa stamping, but your son need to go in either case.
Make sure you either have a project with client letter or your employer has position to employ you on genuine internal project that can be documented well. Its not question of past pay stubs for you. Its about having valid and verifiable employment now.

i was suffered fm TB long time back around 5 yrs back .... i am scared whether due to this reason my I-485 gonna be rejected. I already went trought the full 9 months medication at that time and been fully cures as my own mamaji was a TB specialist.
Can someone suggest me if they have gone through the same case. And if i need any documents to let them know that i am fully cured because my X-ray shows that spot/scars which says that i had TB and my mamaji told me that the scars will never go because of the medcation thing?? Please help

Call USCIS and verify your address. Have you moved receently - sometimes your AR11 change of address may not have been recorded on your case.
I am sure, you will get it anytime.

I changed my address last month and they sent the 485 approval notice to the new address, so I think they've got the correct address. Just wondering why it was taking a while...

We filed 485 on Jul 2nd. So far no receipt yet.:(
My wife's F1 status is going to expire in Aug. She needs to change her status to H4 now. Will the status change have any negative influence on our 485 application? Do we need to send some amendment regarding the COS?

Suppose I am employed in H-1b with employer �X� for position �A�. Employer �X� filed my Labor Certification and I-140 for a future position �B� and got both approved. Position �A� and position �B� have at least 50% different job duties.
I file my I-485 and it is pending for more than 180 days. I get a better offer from employer �Y�. Now, I want to transfer my H1-B to employer �Y� using AC21 portability rule. My job description with employer �Y� should be similar to position �A� or position �B�?

Any significant absence from the US can lead to a finding that one has abandoned permanent resident status. Such determinations are very fact specific. It is a commonly held myth that merely entering the US once a year is sufficient to maintain GC status. If you forsee spending significant time out of the US, you should take steps to protect your GC, such as filing for a re-entry permit. You should also consider maintaining ties to a home in the US.

Hello All,
I have my EAD as does my wife. We are still on valid H1s (until 2009) and I have no plans to change my employer. We also received our travel documents. The question I have, and need your input on is can my wife travel (to India) and back on her H4 (even though we've filed for adjustment of status) or does she have to use her Advance Parole to do so?

sorry to break it to you - but he's quitting a very happy man as every other rupublican is trying to 'out-tancredo tancredo' as he himself put it. he's done his job and poisoned the atmosphere which is all he wanted to do.
I disagree . He thought his immigration stance will take him to white house. He earlier announced that he will not run for congress again. Poison can be taken care of as long as you kill the snake so that it does not bite other people.

I am new to IV. I am just wondering whether we have ever emphasized on bifurcation of Immigration Bill or call for a interim law to facilitate legal immigrant's issues ( mainly retro victims) -
Our problems are very basic and do not have sociopolitical or economical strings attached to it (Probably works better for economy as lot of us are holding on to buy houses and other big budget stuff).
The main issue I have is
- Unable to change jobs
I can wait for GC but not being able to change jobs is hurting me most.
Employers do not find projects and do not pay on bench. Once you find a project Employer wants a big cut. All in the name of policy ;) .
Please share your thoughts.

Hello,
Not that I know ... the worst case scenario is that your green cards are physically mailed to you and then they are returned 'cause nobody was at the home (though normally, it should just sit with your other mail).
When you reenter US, stand in the regular visitor line.... if your card is issued, the IO will know and stamp your passport w temporary green card and allow you in the US.

I have the same problem...(The description of your problem is so similar to mine, I'm thinking that you might be my lawyer trying to fish for an answer to my problem...I paid her thousands of dollars and she gets her answers from the Internet...funny :D)
I am a Brit, filed my I-140 and I-485 in Nebraska for my myself, wife and kids back in Jul-07. The I-140 was sent to Vermont, mine and my wife's I-485 have gone to "the office where they were transferred" (that really narrows it down) and my kid's I-485s were sent to Texas "it has jurisdiction over the case"
Since we live in Texas, I'm not sure why all our papers don't have Texan "jurisdiction".
My lawyers are inquiring with the USCIS and AILA (American Immigration Lawyers Association).

Whats the cost of filing a motion to reopen the case 485 if wrongly rejected(either due to using AC21...). I mean lawyer fees + other fees.
I am sure there are folks here who went through this.
$585 per MTR (ie principal, spouse, child all seperate) to USCIS. Lawyer fee depends on nature of MTR - usually AC21 MTRs are common and the LAWYER fee must be nominal ie in the $1000 per MTR range

I think you are talking about labor certification, but how about I-140
I-140 is specific to PERM labor to the location. If the employer do not apply I-140 within 180 of PERM labor approval that PERM labor will expire.
