Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...

Im in the process of filing a new GC in EB2 category which eventually I will port to my older EB3 application. I wanted to find out if we need to do our Medical exam again during the I-485 stage?

I am currently working for Company A and would like to join company B on EAD. I have a valid EAD and would use it to switch over.
My question is
1. what document's are needed to send to USCIS for AC 21 for/from company B.

I130 petition shows an "immigrant intent" so that could come up as a ground of not allowing a person into the U.S. on a purely non-immigrant visa. I would suggest to speak to an attorney.

I am sorry for posting this message on the Immigration group because it doesnt really relate to the immigration issues. I have been a part of this group for a long time, and hence I thought of sharing this with you all. Although we all are here in the US, we all have our families and friends back home in India. This petition (forwarded to me by my friend) is a petition for safety of our people in India. Please do not consider it as a junk post.

Hi All,
I need some advise on my situation.
I am working in India and my H1B visa has been approved to work with a client in the NJ area. After the visa approval and before the stamping, my employer has asked me to go and work with a different client in the NY area (as my original client project got canceled). So, the client and the location are changing.
So, I will be going for my H1B visa stamping with a client letter and location different from what is in the petition. Is that OK or is it a sure shot denial case?
Do I need a new LCA or H1B amendment? My employer is not keen on doing them, and thinks that it should not be risky to go with the existing paper work.
Please give me some advise.

Pretty soon I'll have to relocate to another city (same job). Wondering if I should continue using my H1B (valid till 2010) or should I use AC-21 to relocate ?
My attorney insists that I use AC-21, and she states that if something goes south during my Adjustment of Status I can re-file for my H1 and she did state the refiling H1 will be exempt from Annual Numerical Limits as I have been on Non-Immigrant visa in the past 6 year and haven't stayed outside the country for over an year.
Is this something I can rely on? Also, what happens to pending AOS(485) if I use this option to refile my H1 from EAD status?

"Has the beneficiary of this petition been previously granted status as an H-1B nonimmigrant in the past 6 years and not left the United States for more than one year after attaining such status?"

How Senator David Vitter (R-LA) is still in Congress after his prostitute scandal escapes me. I am currently studying in the US on an F visa and have managed to loose my passport a couple of months ago. The passport itself is replaced but I hesitated to renew the I-94 since it takes longer time than my duration of status and it is cheaper to just leave the country and send a mail to USCIS later with proof of departure.
To the problem, I am changing status from F to A. Since the interview is not required I was able to obtain the new visa through mail. Now, I am currently in the US with a valid new visa but no I-94 which means I will be out of status two months after my F visa expires. Being close to the Mexican border my plan is to cross it and come back on the same day to officially get the A status and a new I-94. I will of course send photocopies of all the papers and stamps to USCIS to not fall out of status on the previous visa. Are there any legal problems doing this?

I think this rule got changed now. We have to wait for EAD until it is issued. Now we cant go to their office after 90 days for getting EAD

My I-485 case has been transferred from Texas center to Nebraska and notice says it's for faster processing. My priority date is Nov 2003, EB3 category, indian national. I didn't expect they would be looking at my case now. Why would they transfer it? has anyone received any such notice?

I am a july 2nd filer , still waiting for EAD for my spouse .I have got mine a week ago,but her case status has no change. When we call 1-800-375-5283 it says there is no information for this case, however we are able to check the case status online, which says received on October 15, and its still pending.
Another issue is they did not honor the received date.
Is there any one in similar situation?
What can we do at this point? Will Infopass appointment or contacting ombudsman help?

Illegal non-immigrants did the rally to local USCIS offices. It would be good if we pick one day in 2nd week of July and have a rally to local USCIS offices. This will immediately catch the media attention.
Rally news should be spread out to media so we can get enough coverage?
