I have an employee who was a student and then got employment authorization. She asked me to begin the process of getting her an H1B; but then we determined that she really wanted a green card. Can I use the LCA I got for her H1B to apply for her I-i40?

Folks please advise on using POJ method. I tried calling using the instructions below however I always get to customer service instead of NSC where I intend to connect. Am I missing something here ?
Call 1-800-375-5283
Press 1 to select English
Press 2 to skip introduction
Press 2
Press 6 to find case status information
Press 1
Now enter your receipt number SRCxxxxxxxxxx
Voice asks if SRC press 1
Then reads out application number, if correct, press 1 (now listen to the case update info..blah blah)
Part way through the blah blah press 3

I am July 2 filer with Nov 2005 PD EB2-I. Even though I'm happy for others It is indeed frustrating to see my case languish like this. No updates at all. CSR just tells me to wait and wait forever. Opened an SR but nothing happened yet. Very very demoralizing....

Recently my employer has decreased the hourly rate given for many years in the pay stub but providing the difference as bonus. Will it affect my EB2 Classification and I-485 approval.

yes, your employer can file for a new H1B, but you will have to leave the country and get a visa to work on the H1B. An easier process would be for your new employer to take over the sponsorship of your GC by using AC-21.

There really is no science behind the time line to be honest. All i can do is tell you my experience.
I came to the USA in July 2008 on an L1A visa in category EB3 c (Multi national Executive or Manager). On Oct 9th 2009 my companies attorney filed for the I-140 and I-485 concurrently for me and my family. I received my EAD in November 09 and my I-140 was approved on the 18th of March 2010. My green card (I-485) was approved on the 22nd of April 2010 and I received my actual card on the 30th of April 2010.
As I said above there is no science to the time line, its really a case of take a ticket and hope for the best but mine took a total of 6 months from start to finish. This is pretty quick to be honest but my attorney was very good.

I need your advice. My H1B for first 3 years is expiring in Sep 09. I am a consultant and my project is till June 09. So I will be on bench after that till I get a new project. So if I have to file for extension should i file it now when I am in project or should i wait.
When I asked my employer about filing extension, they told that they are getting lot of queries these days. They even told be if my project is getting over early then its difficult to get an approved extension as these days they even have to send the contract letter of clients which do states that when my project is going to end.
So i need to know what are my options.
When Should I file for extension and is there any other options.

I sent my documents for I485 on May 4th. Fedex web site shows that the documents were received by the service center on May 5th. But so far, my checks were not deposited or I haven't received the official receipt. How long does it take usually for USCIS to deposit checks? If I don't get the receipts for another week, what do I do?

My wife's and mine EAD renewal was applied on the 23rd of July (company lawyer delayed filing). I received mine in 30 days but my wife's case is still pending, though I am working on my H1 and don't need it. My wife's current EAD expires today, is there anything we can do to get the process to move faster or get her case expediated other than just wait till 90 days. There are lots of people I know who received their EADs even though their applications were sent much later. If the discontinuity is long, my wife may loose her job.
